United Charities Club Loyalty Program Terms and Conditions

Welcome to the United Charities Club Loyalty Program for Valued Members & Friends of United Charities Club. For over 130 years, the United Charities Building has been a cornerstone of the community, driving growth and progress. United Charities Building proudly upholds the legacy of excellence set by the building’s history and is committed to maintaining its esteemed reputation. To contribute to the ongoing growth of the community, United Charities Building offers this premier club program (the “Loyalty Program”). This initiative aims to fortify the connections between local businesses and the community, while also curating exclusive deals for the esteemed members and associates of the United Charities Building (the “Club Members”).  Please review the following Terms and Conditions carefully before participating in the Loyalty Program:

  1. Loyalty Program: The Loyalty Program offers a range of benefits from the local businesses participating in this Loyalty Program (the “Program Business Partners”). Benefits may vary based on membership tiers. Details of applicable benefits will be listed on the website.
  2. Valid Duration : The Loyalty Program is ongoing at the United Charities Building until December 31st, 2024 (the “Expiration Date”). Following the Expiration Date, a new club card will be issued for another 12 months with updated benefits. The management reserves the right to modify or terminate the program at any time without prior notice.
  3. Non-transferable: The club cards issued by the Loyalty Program are non-transferable and cannot be exchanged for cash or any other form of compensation.
  4. Verification: United Charities Building reserves the right to verify the eligibility of participants and their referred Friends at any time. Misrepresentation of information may result in disqualification from the Loyalty Program.
  5. Compliance: Participants agree to comply with all applicable laws and regulations governing the Loyalty Program. Any violation of these terms and conditions may result in the immediate termination of participation privileges.
  6. Communication: By participating in the Loyalty Program, participants consent to receive communication from United Charities Building regarding program updates, promotions, and relevant announcements.
  7. DISCLAIMER: CLUB MEMBERS ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOUR USE OF THE CLUB CARD IS AT YOUR SOLE RISK. UNITED CHARTIES BUILDING MAKES NO REPRESENTATIONS OR WARRANTIES, AND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, OF ANY KIND, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES THAT YOUR ACCESS TO AND USE OF THE PROGRAM BUSINESS PARTNERS WILL BE AVAILABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL UNITED CHARITIES BUILDING, ITS PARENTS, SUBSIDIARIES OR OTHER AFFILIATES, OR ANY OF ITS OR THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AGENTS, SUCCESSORS AND ASSIGNS (COLLECTIVELY, “UNITED CHARITIES BUILDING PARTIES”) BE LIABLE TO CLUB MEMBERS OR ANY OTHER PERSON FOR ANY DIRECT, CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGESARISING OUT OF OR IN CONNECTION WITH ALL AND ANY OCCURANCES RELATED TO THE PROGRAM BUSINESS PARTNERS.

  1. INDEMNIFICATION. Club members agree to defend, indemnify and hold the us harmless from and against any claims, liabilities, losses, damages, costs and expenses (including without limitation reasonable attorneys’ fees), arising out of or in connection with: (1) your access to and/or use of the Business Partners and their food or/and services; (2) your failure to comply with these Terms or with any applicable law, rule or regulation; or (3) any activity occurring by or through your misconducts or negligence.
  2. Modification of Terms: United Charities Building reserves the right to modify these terms and conditions at any time without prior notice. Participants are encouraged to review the terms periodically for updates.
  3. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the state of New York]. Any disputes arising out of or in connection with the Loyalty Program shall be subject to the exclusive jurisdiction of the courts in the state of New York.

By participating in the Loyalty Program, participants acknowledge that they have read, understood, and agreed to abide by these terms and conditions. Failure to comply with these terms may result in the forfeiture of all benefits associated with the program.
